We hope the following FAQs help to clarify some common questions that our tenants might have for our Legal and Collections Department.

Question: What are my legal obligations as Guarantor?
Answer: A Guarantor is responsible to provide rental payments according to the terms of the lease, should the tenant default on their obligation to do so.

Question: Can a Guarantor be removed from their obligation?
Answer: In order for a guarantor to be removed from their obligation, the tenant must reapply with a replacement Guarantor or alternatively provide proof that they now have sufficient income to cover the rental payments.

Question: My room mate has moved out. Am I responsible for their portion of the rent?
Answer: All tenants listed on our rental agreement are responsible for the rental payments for the duration of the tenancy. In order to have a tenant "removed" from the rental agreement. The remaining tenant or tenants must reapply for the suite and satisfy the conditions of our application process.

Question: My room mate has moved out, can you please remove their name from our lease?

Question: I gave my Building Representative a cheque for my rent today but still received a notice that my rent is unpaid. How can I rectify this error?
Answer: Rent is due on the first day of each month. Rental arrears are costly to us as we have commitments to make each month as well, such as mortgage payments, property taxes and utility costs. It is important that we follow the legal process of collecting these arrears in a timely manner in order to properly manage the properties.

Question: I received a legal document stating that I owe money, but my rent is paid up to date. Who should I contact in order to rectify this?
Answer: If you feel that you have received either a Friendly Reminder or a Notice to Terminate a Tenancy for Nonpayment of Rent Form in error, please contact your Residential Property Administrator who will be happy to investigate and correct any errors.
